Critter Counter (the "Application") is a free iPhone and Apple Watch app that I, Chris Spurlock, built and operate as a solo developer. By downloading or using the Application, you agree to the terms below. Please read them before you start.
The Critter Counter name, logo, and marketing materials remain my property. The compiled Application is licensed, not sold, for personal use. Reverse-engineering of the compiled binary for the purpose of circumventing security or licensing controls is not permitted. Other intellectual property rights related to the Application remain with their respective owners.
I want the Application to be as useful and reliable as I can make it, and I may modify it at any time. If I ever introduce a charge for the Application or for a feature, I will clearly communicate that to you in advance.
The Application stores and processes data that you choose to provide (your email address when you sign in, and the walks and sightings you record). It is your responsibility to keep your device and the Application reasonably secure. I strongly advise against using the Application on a jailbroken device, which can expose your data to malware and may cause the Application to misbehave.
Some features of the Application — signing in, syncing walks across devices, and account deletion — require an internet connection. You are responsible for any data charges your mobile carrier imposes for that connection, including roaming charges when travelling. If you do not pay the device's mobile bill, please make sure you have permission from whoever does.
It is also your responsibility to make sure your device is charged. If the Application is unavailable because your battery is dead, I cannot help with that.
I rely on third parties (currently Supabase for storage and sync, and Firebase Crashlytics for crash reporting) to operate parts of the Application. I do my best to keep things working, but I cannot accept liability for losses caused by their outages or by your reliance on Application data alone.
I may release updates to the Application from time to time, and over time the Application may require a newer version of iOS or watchOS than your device runs. I do not guarantee that I will always update the Application to remain compatible with your specific device. I may also stop offering the Application at any time, without prior notice. If that happens, your rights under these terms end and you should delete the Application from your device.
You may delete your account and all associated data at any time from within the Application's Settings screen. When you do, all personal data — including your walk history, sighting data, and account information — is permanently removed from my systems immediately. Database backups maintained by my infrastructure provider may be retained for up to 30 days as part of standard disaster recovery practices. To request account deletion outside the in-app flow, email me at thefirstzion@gmail.com.
I may update these terms from time to time. When I do, I will post the new version on this page. Please review it periodically.
